Terms of service.

These Terms are a contract between you and Leiko, Inc. ("Leiko," "we," "us"). They cover the Leiko website, the Leiko app, the Leiko watch, orders and shipping, the Leiko Plus subscription, and any related service that links to these Terms. Please read them — using Leiko means you agree to them.

1. Who we are

2. Eligibility

You must be at least 18 to create an account or place an order. If you set up Leiko for someone in your care (a parent, a patient), you confirm you have their consent or, where applicable, lawful authority to share their health information with us and any Family Circle member you add.

3. Your account

Keep your login credentials safe; you are responsible for activity under your account. Tell us right away at security@leiko.app if you think your account has been used without your permission. We may suspend or close accounts that violate these Terms, that are used to defraud us or other users, or that we are legally required to close.

4. Orders and shipping

When you place an order on our site we send you a confirmation email and a secure checkout link to complete payment. Your order is confirmed once payment clears. The price you see at checkout is the price you pay — we do not change it after the fact.

Founder Edition units ship within days of payment, tracked, worldwide. Pre-order units ship with the next production batch on the date we email you to confirm. If we ever miss the confirmed ship date for a pre-order, you are entitled to a full refund — no forms, no questions, no waiting. Just reply to your order email or write to orders@leiko.app.

Title and risk of loss for the watch passes to you on delivery to the address you provided. Please inspect your shipment within 7 days and tell us at orders@leiko.app if anything arrived damaged.

5. Refunds and returns

Cancellation before shipment. You can cancel an unshipped order any time for a full refund. Just reply to your order email or write to orders@leiko.app.
Founder Edition units. 30-day return window from delivery, in original condition with all included accessories. Original shipping is non-refundable; return shipping is at your cost unless the unit is defective.
Pre-order units. 100% refund if we miss the confirmed ship date. Otherwise the 30-day return window applies as above.
Defective hardware. Covered by our 12-month limited warranty (Section 8). Out-of-pocket cost to you for a warranty replacement: zero, including return shipping.

6. Leiko Plus subscription

Leiko Plus is an optional subscription that unlocks AI weekly summaries, Doctor-Ready PDFs, multi-caregiver Family Circle access, and anomaly alerts. Pricing is $4.99/month or $39.99/year (or the local equivalent shown at checkout). Subscriptions renew automatically until you cancel.

Cancel any time in Settings → Subscription. You keep access through the end of the period you have already paid for. We do not pro-rate refunds for the current period unless your local law requires it.

The free tier of the Leiko app always includes unlimited readings, your full history, and basic trends. We do not put your health data behind a paywall.

7. Medical and safety disclaimers

Leiko is not a substitute for medical care or an emergency service. The Leiko watch is a continuous-monitoring instrument and the Leiko app helps you and the people in your care understand the trends it produces. It does not diagnose disease, prescribe medication, or replace the judgement of a qualified clinician. Always consult your physician for medical advice and treatment decisions.

If you think you are experiencing a medical emergency — chest pain, sudden severe headache, loss of consciousness, signs of a stroke, or any other urgent symptom — call your local emergency number (911 in the US, 999 in the UK, 112 in the EU) immediately. Do not rely on a Leiko reading or notification.

The watch measures blood pressure using oscillometric measurement (the same method clinical arm cuffs use) and is registered as a medical device in the US (FDA Establishment Registration #3011654863) and the EU (EU MDR Class IIa). Always position the watch as instructed; readings taken with poor cuff position or excessive motion may be inaccurate.

8. Warranty

We warrant the Leiko watch and charger against defects in materials or workmanship for 12 months from delivery. If the device fails during that period, write to orders@leiko.app and we will repair or replace it at our cost. This warranty does not cover accidental damage, water damage beyond the IP rating stated in the product spec, normal wear of the strap, or damage caused by modification or third-party repair. Some jurisdictions grant statutory warranties that go beyond this; nothing here removes those rights.

9. Acceptable use

Don't use Leiko to harm others. Specifically:

Don't monitor anyone — child, partner, employee, patient — without their informed consent (or, where applicable, lawful authority such as parental responsibility for a minor).
Don't reverse-engineer the watch firmware, the app, or our APIs, except where the law expressly permits.
Don't attempt to break, probe, or interfere with our services, or use them to send spam, malware, or abusive content.
Don't resell Leiko hardware as new or relabel it as another brand.

We may suspend or terminate access for material breaches.

10. Intellectual property

Leiko, the constellation mark, the Leiko app, the watch firmware, and the words and images on our sites are owned by Leiko or our licensors. You get a personal, limited, non-transferable, non-exclusive licence to use them — that's it. The health data and notes you create remain yours; you grant us the licence we need to host and process them on your behalf, as described in our Privacy Policy.

11. Beta features

Some features may be labelled "beta" or "preview." Those are exactly that — pre-production. They can change, break, or be removed. Don't rely on them for medical decisions.

12. Service changes and termination

We may add, change, or retire parts of the service. If a change materially reduces the service for a paid feature you rely on, we will give you at least 30 days' notice and a refund of any unused subscription time. You can close your account at any time in Settings; closing it cancels active subscriptions and starts the deletion process described in our Privacy Policy.

13. Disclaimers and limitation of liability

To the maximum extent the law allows, the service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under applicable law.

To the maximum extent the law allows, Leiko's aggregate liability for any claim arising out of or related to the service is limited to the greater of (a) the amount you paid us for the hardware or subscription giving rise to the claim in the 12 months before the claim, or (b) US $100. Neither party is liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits or data.

14. Indemnity

You will indemnify Leiko for third-party claims that arise from your breach of these Terms or your unlawful use of the service, except to the extent the claim arises from our own breach.

15. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. The Hague Convention and the UN Convention on Contracts for the International Sale of Goods do not apply.

If you are a consumer in the EU or UK, you also benefit from the mandatory consumer-protection rules of the country where you live, and you may bring proceedings in your local courts. We will not insist on Wyoming as the exclusive forum for consumers in those jurisdictions.

For everyone else: any dispute must be brought in the state or federal courts of Sheridan County, Wyoming, and you and Leiko consent to the personal jurisdiction of those courts. Before filing suit, please write to law@leiko.app; we'd rather sort it out.

16. General

These Terms are the entire agreement between you and Leiko about the service. If a court finds any part unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor to our business. We will give you reasonable notice (at least 30 days for paid users) before any material change to these Terms.
